Reminder: California Pay Reports Are Due on May 8, 2024

This is the second year that California is requiring employers to report not only their employees’ pay data but also pay data for individuals hired through labor contractors (i.e., staffing agencies). The reports are due May 8, 2024.

Who Needs to Submit a Pay Data Report?

  • Employers with 100 or more employees worldwide

  • Companies with 100 or more individuals placed with them worldwide through a labor contractor

Keep in mind that the pay data report includes individuals who physically work in California, as well as those who work outside California but are assigned to an establishment in California (e.g., a remote employee in Colorado, who is assigned to an establishment located in Los Angeles).

What Data Must Be Submitted?

Organizations required to submit a Pay Data Report must collect the following information:

  • The median and mean hourly rate for each EEO-1 job category, by race, ethnicity, and sex.

  • The number of employees (or staffers) by race, ethnicity, and sex by job category (same as those found on an EEO-1 report)

  • The number of employees (or staffers) by race, ethnicity, and sex, whose annual earnings fall within the Occupational Employment and Wage Statistics (OEWS) pay bands.

  • Report generated from a “snapshot” of all the employees (or staffers) employed during a single pay period between October 1 and December 31 of the reporting year.

  • Total number of hours worked by each employee (or staffer) during the reporting year.

  • Employer’s NAICS code.
